Online Fundraising Auction of Architectural Drawings


Terms and Conditions
This agreement describes the terms and conditions applicable to your use of our services at http://www.aaschool.info/auction. If you do not agree to be bound by this agreement, you may not use or access our services. You must read, agree with and accept all of the terms and conditions contained in this agreement before you may become a registered bidder. This agreement is effective from 15 May 2003 for all new registering users.

The Auction is not available to persons under the age of 18 years. If you do not qualify, please do not use our services. If you are registering as a business entity, you represent that you have the authority to bind the entity to this Agreement.

You will be assigned a user password on completion of registration. You are responsible for all actions taken under that password. It is your responsibility to keep your password safe, and you have no right to disclose or transfer your password to any other person.

By bidding on an item, you agree to be bound by the conditions of sale included in the item’s description. As a buyer, you will be obligated to complete a transaction if you are the highest bidder at the end of the Auction. Items will be supplied as they were received from the donors. If the item is framed or mounted, it will say so on the item’s description.

All lots are exempt from VAT (sales tax). The auction price does not include postage and packaging, which is the buyer’s responsibility. Purchased lots will be available for collection from the Architectural Association, 36 Bedford Square, London, from the moment the Auction is closed on the evening of Thursday 5 June. Alternatively, shipping of purchased lots can be arranged directly with Micki Hawkes and will be priced on an individual basis. All fees are payable in GB Pounds Sterling.

You are solely responsible for any information you provide to us in relation to the Auction service, including the registration, bidding, and any other content that you post within our website. Your information and your activities on our Site must not be false, inaccurate or misleading, offensive or menacing, abusive, defamatory, fraudulent or in breach of any applicable laws or regulations. Communications received from you must not contain any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority or expropriate any system, data or personal information.

You agree that you will not copy our website or the content contained therein without our prior express written permission. You agree that you will not interfere or attempt to interfere with the proper working of our website or the auction being conducted on our website. You agree that you will not take any action that imposes or may lead to an unreasonable or disproportionately large load on our infrastructure. You agree that you will not and will not induce others to copy, reproduce, alter, modify, create derivative works, or publicly display any content from our website without the prior express written permission of the Architectural Association.

Without limiting our other remedies, we may immediately issue a warning, suspend or terminate your user registration and refuse to provide our services to you without notice to you: (a) if you breach this Agreement; (b) if we are unable to verify or authenticate any information you provide to us; or (c) if we believe that your actions may cause legal liability for you, our users or us.

Please note that your information will be stored and processed on our computers in London, and will be treated according to current UK Data Protection legislation. The Architectural Association will not sell or rent your personal information to third parties.

We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our website may be interfered with by numerous factors outside of our control. Our website and our services are provided ‘as is’ and as and when available.

Unless otherwise explicitly stated, notices to the Architectural Association must be sent to micki@aaschool.ac.uk, or by registered mail to Micki Hawkes, The Architectural Association, 36 Bedford Square, London WC1B 3ES. Notices to you will be sent to the email address that you provide during the registration process (receipt is deemed 24 hours after an email is sent, unless we receive notice that the email address is invalid).

This Agreement shall be governed by and construed in accordance with English law and subject to the non- exclusive jurisdiction of the English courts. Note, however, that your country may have laws which apply regardless of what you agree with us. You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service and your bidding on items.

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforced.
